EAR Compliance

The Export Administration Regulation (EAR) is managed and enforced by the Bureau of Industry and Security, an agency under the umbrella of the Department of Commerce. These regulations control the export of goods and technology that are “dual-use” items, or items that have both civilian and military applications. The items managed under the EAR are listed in the Commerce Control List (CCL), which has a comprehensive categorization scheme under which each item is classified with an Export Control Classification Number (ECCN). Each ECCN has a list of controls that indicate the conditions under which a license is required for the export of a good or technology, or whether there is a license exception available for such an export.

The entire EAR taken together with the CCL, exception rules, licensing rules, embargos and other supplemental rules presents a complex task for compliance officers to manage their organizations’ adherence to the regulation. The EAR has over thousands of different classifications and sub-classifications and thousands of different control combinations.
